General Terms and Conditions
Effective from: October 25, 2025
These terms and conditions govern the relationship between the service provider Mgr. Karel Soukop (KS AERIAL WORKS), ID: 23515805 (hereinafter referred to as the "Provider") and the service client (hereinafter referred to as the "Client").
1. Introductory Provisions
The Provider offers aerial services using unmanned aerial systems (drones), primarily focusing on thermography, photogrammetry, video/photo production, and related consulting and data processing.
Services are provided in accordance with the valid legislation of the Czech Republic and the regulations of the CAA (Civil Aviation Authority).
2. Order and Flight Cancellation
- The ordering of services takes place in writing (e-mail, form) or by phone, followed by written confirmation.
- Weather: Aerial work is dependent on weather conditions. The Provider reserves the right to postpone or cancel a flight at any time for safety reasons (rain, strong wind, low cloud cover, geomagnetic storms). In such a case, no cancellation fee is charged, and an alternative date is arranged.
- Cancellation by the Client: If the Client cancels a confirmed service less than 24 hours before the scheduled takeoff for reasons other than weather, the Provider may charge a cancellation fee corresponding to the costs already incurred (e.g., travel expenses, mission preparation, permits).
3. Safety and Legislation
- The pilot (Provider) is solely responsible for flight safety. The pilot has the right to refuse to conduct a flight if it would endanger the safety of persons or property, or violate legislation.
- The Provider will secure all necessary permits for operation in the given location (if legally possible).
4. Prices and Payment Terms
- Prices are contractual and based on the current price list or individual calculation.
- The Provider is not a VAT payer. The stated prices are final.
- Deposit: For large-scale orders or specific projects ("Custom Missions"), the Provider is entitled to request a deposit of 50% of the estimated price. The booking of the date becomes binding only after the deposit is credited to the Provider's account.
- Invoices (balance payment) are generally due 14 days after the delivery of the work, unless the parties agree otherwise.
5. Copyrights and Licenses
- All data, photographs, and videos captured by the Provider are copyrighted works.
- By paying the service price, the Client obtains a non-exclusive, temporally and geographically unlimited license to use the work for their needs (presentations, project documentation, marketing).
- The Provider reserves the right to use the captured materials for their own promotional purposes (portfolio, website, social media), unless agreed otherwise in writing with the Client (e.g., for classified projects).
6. Liability for Defects and Complaints
- The Provider guarantees that the services will be provided to the agreed extent and quality (e.g., photo resolution, mapping accuracy).
- Filing a complaint: The Client is obliged to check the delivered data (outputs) without undue delay, no later than 5 working days from their delivery. Any defects must be reported to the Provider in writing, including a description of the defect.
- Justified complaint: If the complaint is justified (an error on the part of the Provider), the Client has the right to free rectification (e.g., a repeated flight, data correction) or a reasonable discount on the price.
- Exclusions from liability: The Provider is not responsible for defects caused by inappropriate instructions from the Client (e.g., incorrect GPS coordinates of the plot, unsuitably chosen flight time at the Client's request) or force majeure.
